Terms of Service
Effective date: June 7, 2026
These terms govern your use of Consentico ("the Service"), provided by the Consentico team ("we", "us"). By installing the app on your Shopify store, you agree to these terms.
1. Service description
Consentico is a cookie consent management platform for Shopify merchants. We provide a configurable consent banner, automatic script blocking, a cookie scanner, and an audit-ready consent log.
2. Compliance disclaimer — read this carefully
Consentico is a tool that helps you achieve compliance with privacy regulations including GDPR, CCPA, CPRA, LGPD, and similar laws. Consentico is not legal advice, not a legal opinion, not an attestation of compliance, and not a substitute for a qualified privacy lawyer.
You are the "data controller" for personal data collected on your storefront under GDPR, CCPA, and equivalent laws. We act as your "data processor" in respect of consent records and related metadata we store on your behalf. As the controller, you remain responsible for:
- Configuring the app correctly for your store, your products, your third-party integrations, and the jurisdictions you operate in
- Maintaining a privacy policy, cookie policy, and any other legally required notices on your store
- Verifying that the cookie categorization Consentico generates accurately reflects how you and your third-party services actually use those cookies
- Responding to data-subject requests within statutory deadlines
- Determining the lawful basis for processing under GDPR Article 6 and obtaining valid consent where required
- Auditing and updating your compliance posture as regulations, your storefront, and your third-party scripts change over time
The cookie scanner is a best-effort detection tool. It identifies cookies and scripts present on your storefront at scan time and proposes a category based on a regularly updated knowledge base. It cannot detect every cookie in every configuration, cannot determine the legal status of a cookie in your specific use, and may mis-categorize cookies whose purpose depends on context the scanner cannot observe. You must review scanner output before relying on it for compliance purposes.
Installing or configuring Consentico does not create a presumption of compliance. A regulator, court, or auditor assessing your compliance will look at your actual practices, not the presence of any tool. For specific legal questions, consult a qualified privacy lawyer in your jurisdiction.
3. Your account
Your Consentico account is tied to your Shopify store. Authentication and access control flow through Shopify; we do not maintain separate Consentico passwords. Keep your Shopify account secure.
4. Billing
Consentico is billed exclusively through the Shopify Billing API. By subscribing to a paid plan you authorise Shopify to charge your store on a recurring monthly basis. You can upgrade, downgrade, or cancel at any time from inside the app. Cancellations take effect at the end of the current billing period; we do not pro-rate partial months.
Free trials run for 7 days; you will not be charged if you cancel before the trial ends.
5. Acceptable use
You agree not to:
- Use Consentico to perform any illegal activity
- Attempt to reverse-engineer, decompile, or otherwise extract our source code
- Resell or sublicense the Service without our written permission
- Misrepresent your consent log or modify it to deceive regulators or data subjects
- Use the Service to circumvent privacy laws (e.g. setting "essential" on a category that isn't actually essential to bypass consent requirements)
- Represent to your customers, regulators, or any third party that Consentico's output, scanner reports, compliance score, or installation status constitutes legal advice, a legal opinion, a certification, or an attestation of compliance from us
- Use Consentico to provide consent management services to third parties (e.g. as a white-label CMP) without a separate written agreement with us
6. Data ownership
You own your data. We are a data processor acting on your instructions. See our Privacy Policy for the full description of what we store and for how long.
You can export your consent logs as CSV at any time on Pro and Business plans. On uninstall, we delete all your data — see the Privacy Policy for the timeline and process.
7. Service availability and warranties
We aim for high availability but do not currently offer a formal SLA. The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we make no warranty that the Service will achieve, maintain, or evidence compliance with any specific law, regulation, code, or standard. We may perform maintenance with reasonable notice, and may experience outages outside our direct control (Shopify, our hosting provider, Cloudflare, etc.).
If our infrastructure is unavailable, the storefront cookie banner continues to render based on configuration cached in a Shopify metafield. Compliance is preserved even during our outages — we never let billing or analytics state cause a compliance gap on the storefront.
8. Intellectual property
The Consentico name, logo, and all software comprising the Service are owned by us or our licensors. You receive a non-exclusive, non-transferable licence to use the Service on your Shopify store for as long as your subscription is active.
9. Termination
You can stop using the Service at any time by uninstalling the app from your Shopify admin. We may terminate or suspend access to the Service if you materially breach these terms; we will give you reasonable notice unless the breach is severe (e.g. illegal use).
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
11. Changes to these terms
We may update these terms from time to time. Material changes will be announced on this page and, for paid plans, by email at least 30 days before they take effect.
12. Governing law
These terms are governed by the laws of the jurisdiction in which the operator of the Service is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of competent jurisdiction in that location.
